ARTICLE 3.300 BUILDING CODE



(a) A certain document, a copy of which is to be maintained on file in the office of the city secretary of the City of Oak Leaf, being marked and designated as the 2003 International Residential Code for One- and Two-Family Dwellings, promulgated by the International Code Council, Inc., be and is hereby adopted as the residential building code of the City of Oak Leaf, in the State of Texas, for the control of building and structures for residential use as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said building code are hereby referred to, adopted and made a part hereof, as if fully set out in this article, with the additions, insertions, deletions and changes, if any.

(b) The city further adopted the 2003 International Building Code, the 2003 International Plumbing Code, the 2003 Fuel Gas Code, the 2003 International Mechanical Code, the 2003 Energy Conservation Code, as published by the International Code Council.

(c) These codes are adopted for the purpose of establishing rules and regulations for construction, alteration, removal, demolition, equipment, use and occupancy, location and maintenance of buildings and structures, including permits and the same is hereby adopted and incorporated as fully as if set out at length herein, subject to all amendments, deletions and conflicting provisions contained in this code of ordinances; and from the date on which this article shall take effect, the provisions thereof shall be controlling in the construction of all buildings and structures within the corporate limits of the City of Oak Leaf and within its extraterritorial jurisdiction (ETJ).

(d) Any local amendments shall prevail over any conflicting provisions of the above referenced codes. These codes are hereby incorporated by reference as if fully set out in this article.

(e) Penalties. Any person, firm or corporation who shall violate any of the provisions of this article shall be guilty of a misdemeanor and upon conviction shall be fined in accordance with the general penalty provision found in Section 1.106 of this code and each and every day’s violation shall constitute a separate offense.
