ARTICLE 3.400 CONSTRUCTION



Sec. 3.401 Driveways and Other Flatwork

(a) All driveways shall be constructed as follows:

(1) All culvert pipe shall be Class 1, reinforced concrete or corrugated metal pipe meeting requirements of ASTM specification A444 or AASHTO designation M36 or code approved driveway form work and culvert pipe to be inspected by inspector prior to installation of any concrete.

(2) Material - concrete 4 sack mix

(3) Driveway Width - 9 feet

(4) Approach Width - 16 feet

(5) Apron Width - 21 feet Reinforcement - 3/8 inch rebar steel 24″ O.C.B.W. or #666 mesh wire.

Sec. 3.402 Heating and Cooling

(a) Approved factory-made air duct installed according to the manufacturers instructions shall be allowed as long as material is sized for proper air flow and as long as all flexible material is fully extended and cut to length without unnecessary bends and turns. Flex duct must be supported no less than every four (4) feet in the horizontal position and no less than every six (6) feet in the vertical position. Ceiling joists shall be an approved method of support for horizontal runs.

Factory-made air duct is only approved for the use intended and shall conform to the requirements of UL 181. All factory-made flex-duct over three (3) feet in length must display a label indicating the manufacturer, the size and the insulation value. Factory made air ducts must not have a flame spread rating greater than 25 nor a smoke density index greater than 50.

(b) Metal duct must be used three (3) feet from the plenum then flex duct is allowed.

Sec. 3.403 Roofing

(a) Wood shingles shall not be used within the city limits of the City of Oak Leaf, Texas.

(b) Fiberglass or approved 320 lb. weight shingles or better must be used.

(c) Metal roofing is allowed only if it is 20 lb. Terne Metal or 16 oz. Copper as approved by the building inspector per The International Building Code.

Sec. 3.404 Masonry

A minimum of 80% masonry exterior walls is required on all new principal dwellings.

Sec. 3.405 Swimming Pools

(a) Always have electric, water, telephone and sewer lines marked before construction begins.

(b) If possible, contact neighbors for the deposit of dirt or fill. May be cheaper to give it to someone in need of this soil than to haul it off.

(c) Make sure the pool site has a proper access for the large trucks needed to build this structure.

(d) Ask the pool excavation crew to put in pier holes on a shallow pool or a pool hole that does not have a definite change of soil. Piers should be at least 10-24″ deep-rock 12″ diameter and spaced evenly throughout the site.

(e) The steel crew should place steel in a 8-12″ pattern in the shallow end with it reducing to a 6-8″ grid in the deepest part of the pool.

(f) All steel should be uniform in size - min. 3/8″ rebar for shell and min. 1/2″ for sides or spa add-ons.

(g) Steel must be raised during gunite procedure - spacers or bricks may be used.

(h) Minimum thickness of gunite must be adhered to - 4-6″ on floor of pool 10-12″ on side forms.

(i) All electrical equipment must be GFI or equal.

(j) All plumbing materials must meet minimum requirements - schedule 40 PVC/Copper or brass fittings/all joints must show primer before glued.

(k) If pool site is higher than residence, proper drainage plan must be presented to town inspector.

(l) Minimum of a 4 foot high fence with self latching, self closing gate must be erected upon immediate completion of pool.

(m) All contractors should be bonded for completion of pool/time allocated for completion/materials and warranties.

(n) All decks built around the pool area should adhere to standard concrete driveway/walkway specifications.

(o) Any damage to streets or roads in Oak Leaf due directly to a pool contractor or agent in the process of building a pool should be repaired at their cost within 7 days of occurrence.

Sec. 3.406 General

In addition to the 2003 International Building Code, the following are required by ordinance in the City of Oak Leaf: (Ordinance 0413 adopted 12/14/04)

(1) All property is zoned as single family residential and no property may be subdivided except as stated in the rules and regulations established in Chapter 9 Subdivisions.

(2) All slab foundation shall be constructed as follows:

Slab Material - Concrete 5 sack mix
Slab Thickness - 4 inches
Reinforcement - 3# bar @ 18″ O.C.B.W.
Fill - 4 granular
Beams - Exterior - Width 10″, Depth min. 20″ or 6″ into undisturbed soil
Beams - Interior - Width 8″, Depth min. 12″

(3) All electrical in the City of Oak Leaf is underground.

(4) 2003 International Plumbing Code: Test: 10′ head of water. Run pipe 10′ higher than horizontal drain. No section shall be tested with less than 10′ head of water. (Ordinance 0413 adopted 12/14/04)

NOTICE: Senate Bill 587 mandates water conservation by establishing water saving performance standards as follows:

(A) Flush Tank Water Closets - 1.6 GPM

(B) Flush Valve Water Closets - 2.0 GPM

(C) Urinals - 1.0 GPM

(D) Lavatories - 2.2 GPM - 60 psi

(E) Shower Heads - 2.75 GPM - 80 psi

(F) Sink Faucet - 2.2 GPM - 60 psi

(G) Drinking Fountains must be self-closing. An exception to the law provides for specialty fixtures such as emergency eyewashes and handicap showers.

(H) See Chapter 6, Article 6.100.

(I) A minimum of one (1) smoke detector per floor per 1,000 sq. feet must be installed and in operating condition.

(J) Builder needs to check ordinances for various restrictions in different areas of the city.

(K) All plans must be gone over by the building inspector and approved before building is started.

(5) Factory Built Fireplaces:

(A) Per 2003 International Building Code, Fire Places.

(Ordinance 0413 adopted 12/14/04)

(B) Factory built fireplaces shall be accepted when installed in a masonry enclosure and vented by a masonry chimney or through a masonry enclosure.

(6) Minimum Square Feet for Living Area in Newly Erected Residential Buildings. All new home construction have a minimum square footage of two thousand (2,000) square feet of heated and air conditioned living space (exclusive of garage areas), except for the area identified as Willow Creek Farms, which shall have a minimum of two thousand three hundred (2,300) square feet.

(7) Lots. All lots, so far as practicable, shall have the side lines at right angles to the street on which the lot faces, or radial to curved street lines. All lot corners, angle points, points of curves, etc., shall be marked with steel rods or concrete markers securely fastened in the ground. All lots shall have a minimum lot size of one acre (i.e., 43,560 square feet), except those lots in the area identified as Willow Creek Farms shall have a minimum lot size of two acres (i.e., 87,120 square feet). All lots to be used for construction of a residential building shall have minimum width characteristics as specified in the chart below.

(8) Building Lines.

(A) Front dwelling unit building lines shall apply to all lots intended for residential use, and shall provide for a minimum set-back of at least the distance specified in the chart below, as measured from the road right-of-way.

(B) Nondwelling unit front building lines shall apply to all property and shall provide for a minimum set-back of at least the distance specified in the chart below, as measured from the road right-of-way, but in no case shall be less than 40 feet beyond the existing dwelling unit’s front building line.

(C) Side building lines for dwelling units shall apply to all property and shall provide for a minimum set-back of at least the distance specified in the chart below, and must be a minimum of 30 feet from the side street on all corner lots. Side building lines for nondwelling units must be at least 10 feet and must equal that of dwelling units on all corner lots.

(9) Utility Easements. Utility easements of not less than ten feet (10′) shall be provided on each side and rear lot lines, unless an alley is provided. Additional utility easements may be required by the city.

(10) Drainage Easements. Provisions shall be made for drainage easements to allow for proper control of drainage and for future maintenance within the easement area. Provisions for drainage shall be made as required by the β€œPublic Works Construction Standards,” by the North Central Texas Council of Governments, and in compliance with all applicable Federal Emergency Management Agency (FEMA) requirements. All new lots shall be graded to provide drainage, which prevents runoff from impacting adjoining properties. (Ordinance 0505, adopted 5/10/05)

(11) Builders and developers are requested to honor the deed restrictions for their respective area in Oak Leaf.
